This Terms of Service (“Agreement”) applies to the websites, applications, and other online services (collectively, the “Services”) offered by Skatersthinkph (referred to as “Company”, “we”, “us”, or “our”). We may, at our sole discretion, refuse or cancel any order placed through the Services, limit quantities purchased per person, per household, or per order, and refuse service to any customer.
Refunds and cancellations are processed according to the following policies: (1) For physical products, you may request a refund or exchange within 14 days of receipt, provided the product is unused and in its original packaging. (2) For digital products or services, all sales are final and no refunds will be issued unless the product is defective or not as described.

You retain 100% full ownership of all text, images, video, sound, ideas, and other materials ("Content") you submit, post, or upload to the Services. By submitting Content to the Services, you grant us a limited, non-exclusive, revocable, royalty-free license solely to display, host, format, and distribute your Content as necessary to operate your campaign and promote the platform during the active duration of your project. We do not acquire any ownership rights, distribution rights outside platform promotion, or derivative modification rights to your intellectual property. You represent and warrant that you own or control all rights to your submitted Content..
You agree not to use the Services for any of the following purposes: (1) to violate any applicable law or regulation; (2) to infringe upon the intellectual property rights of others; (3) to engage in any fraudulent or deceptive activity; (4) to transmit any viruses, malware, or other harmful code; (5) to harass, threaten, or abuse other users; (6) to engage in any activity that disrupts or interferes with the operation of the Services.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE, OUR AFFILIATES, OR OUR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES.
You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) your use of the Services; (2) your violation of this Agreement; (3) your violation of any rights of a third party.
We reserve the right to modify this Agreement at any time in our sole discretion. We will notify you of any material changes by posting the updated Agreement on the Services or by providing other notice as appropriate. Your continued use of the Services after the effective date of the changes constitutes your acceptance of the revised Agreement.
We may terminate or suspend your access to the Services at any time, without prior notice or liability, for any reason whatsoever, including without limitation if you breach this Agreement. Upon termination, your right to use the Services will immediately cease.
This Agreement shall be governed by and construed in accordance with the laws of the Philippines, without regard to its conflict of law principles. Any disputes arising out of or relating to this Agreement or the Services shall be resolved through arbitration in accordance with the Arbitration Law of the Philippines.
